Unitization Summary
The Division of Oil and Gas Resources Management of the Ohio Department of Natural Resources (“Division”) has authority over the permitting, drilling, operating and plugging of oil and gas wells in Ohio. This authority ensures uniform statewide regulation of oil and gas activities and promotes conservation through the effective development of oil and gas resources. The following is a broad overview of the law providing for the “unitization” of tracts of lands. See Ohio Revised Code 1509.28. This overview is provided as a tool to help owners of oil and gas minerals understand the unitization process.
Ohio law, like the laws of many oil and gas producing states, provides a means to combine mineral rights from individual tracts of land to form a drilling unit to efficiently and effectively develop the oil and/or gas resources beneath those tracts. Ohio Revised Code Section 1509.28 is commonly known as the unitization law.
Unitization is available when the owners of sixty-five percent of the land overlying a pool (or part of a pool) of oil and/or gas apply to the Division to operate the pool (or part of a pool) as a drilling unit. The applicant must demonstrate the proposed drilling unit is (1) reasonably necessary to increase substantially the ultimate recovery of oil and gas and (2) the value of the estimated additional recovery of oil or gas exceeds the estimated additional cost incident to conducting the operation.
After receiving a unitization application, the Division reviews it and, if properly submitted, the Division sets a time for a hearing. During the hearing, the Division hears testimony from the applicant in support of its unitization application. Any person that may have an oil and/or gas interest in the proposed unit may present oral and/or written statements at the hearing and those will be reviewed by the Division before determining whether to approve or deny the application. Written comments may also be sent to the Division at any time prior to the hearing for consideration.
After the hearing, the Division considers all testimony presented at the hearing and any written comments received and then decides if the application should be granted based upon the law. An order is then issued. If the application is approved, the order establishing the unit will specify the terms and conditions for unit operation on a just and reasonable basis. An order approving the application allows the applicant to drill inside the unit once all other necessary permits have been obtained.
Unitization FAQ
Why am I receiving this notice? The Applicant identified you as having mineral interests or potential mineral interests in the unit.
I don’t believe I have mineral interests in this unit. Please contact the Applicant to discuss why you were identified as having mineral interests or potential mineral interests.
The person who this was addressed to is deceased. Please contact the Applicant to discuss this situation and to identify what, if anything, needs to be done to update the mineral interest owner.
Do I have to attend the hearing? No, mineral interest owner attendance is optional.
Can I attend on behalf of someone in the unit? Yes, our hearings are public hearings.
How do I find out the outcome of the hearing? The Division will either approve or deny the application by an order. There is no timeframe for order issuance. If an order is issued, it will be posted to the Division’s website.
How can I request a transcript of the hearing? You can make a public records request for the transcript. Please note, the Division does not generally receive transcripts for 10-15 business days from the date of the hearing.
I received a letter that an order was issued, do I need to do anything? There is nothing that you need to do. However, if you are not leased and would like to lease, you can contact the Applicant. There is nothing in the order or the statute that prevents you from leasing at any point. Appeal rights are provided at the bottom of the order.
How do I update my address? You can contact the Applicant to update your address. The Applicant provided the address to the Division.
An order was issued, so what is the status of the well(s)? You can contact the Applicant to inquire about the status of their well(s) or you can check the Oil and Gas Well Locator.

These affidavits must also be provided electronically to the Division the day of the hearing.
All exhibits submitted to the Division at the time of hearing must contain information that is accurate up to the date of the hearing.
Chief's Determination
After the hearing, the Chief will determine whether the application satisfies the requirements of R.C. § 1509.28. The Chief is required to issue an order either approving or denying the application. If the Chief approves the application, the order will be upon terms and conditions that are just and reasonable and will prescribe a plan for unit operations pursuant to R.C. § 1509.28.
The applicant must provide any updated information to the Division as soon as practicable, and must provide the Division with any necessary updates to the application materials. For example, if tracts of land shown as “unleased” at the time of application are subsequently leased by the applicant, the applicant must provide the Division with an updated map and landowner list reflecting these changes, along with a copy of the executed lease or memorandum of lease.
Withdrawal of Application
The applicant must immediately notify the Division, by electronic mail, of withdrawal of an application for unitization. The applicant must also file a “Notice of Withdrawal of Application” within 5 days of making the notification to the Division.
WebEx Tips and Recommendations
- Ensure you are able to join the hearing via WebEx. You may sign in to WebEx approximately 15 minutes prior to a hearing.
- For an orderly hearing, the microphones of everyone participating in the hearing will be muted except for those actively presenting. If you wish to make comments, please listen and the Division will direct you to unmute and comment at the appropriate time.
- Using a headset with a microphone or headphones is recommended if you plan to participate in the hearing. A headset or headphones will minimize feedback from your computer speakers.
- If you are unable to join WebEx, please call in to the hearing. The call in number and access code are provided both in the Division’s hearing notices and on the website under the hearing’s event page.
- If the Division is unable to hear you through WebEx, the Division staff may ask you to call in via phone. This is to ensure your comments are included in the record for the hearing.
- If you have joined via WebEx and are making comments, please turn on your camera (if available) when you are speaking. This will help the hearing participants and the court reporter.
- Please wait to speak until you are called upon by the Division staff and/or wait until the person speaking is done before answering. This is to ensure that no one is speaking over anyone else and that our court reporter can create a clear record.
- If you have called in with a telephone, you can unmute yourself by pressing *6.
