Oil and Gas Rulemaking

Rulemaking Process

The Division of Oil and Gas Resources Management (Division) is actively working to update its sections of Ohio Administrative Code (1501:9) that regulate oil and gas activity in Ohio. Our goal is to develop the best possible set of rules in an efficient manner, while offering multiple opportunity for input from our stakeholders including those who will be directly affected by rules once enacted.

Typically, a new or amended rule offers three opportunities for public involvement:

Draft Rule Informal Review Phase

The Division will post a copy of the draft rule for early stakeholder review and comment. All stakeholders are welcome to provide comments in writing to Division of Oil and Gas Resources Management, 2045 Morse Road, Building F, Columbus, Ohio 43229-6693. The Division will evaluate all comments and will revise the draft rule in response to constructive comments. However, the DOGRM will not prepare a formal response to each comment.

Common Sense Initiative (CSI) Draft Rule Review

The Division is required to file each draft rule with the Common Sense Initiative Office (CSI) and address a standardized set of questions posed by CSI. The Division will post notices of the filing on this page. The DOGRM will designate the duration of the stakeholder comment period based upon the complexity of the draft rule and the significance of revisions made in response to comments filed during the informal review period. The DOGRM will categorize all comments; prepare a response to comments that address the stated scope of draft rule; and post a response on our website.

Joint Committee on Agency Rule Review (JCARR) Proposed Rule Review

The Division will post a Notice of Intent to adopt a rule in the Register of Ohio and on our website at least 30 days before a scheduled public hearing. The notice will announce a date, time and location for a hearing on the proposed rule. The notice will include a rule synopsis and a copy of the proposed rule. At the hearing, any person affected by the proposed rule may present their comments orally or in writing.
